Article 7: Comprehensive User Obligations, International Regulatory Compliance Assumptions, Limitation of Liabilities, and Order Management Policies.
By proceeding beyond this point, accessing the digital storefront, browsing the product catalog, adding items to your virtual shopping cart, initiating the checkout sequence, providing payment information, and ultimately clicking the button to confirm and finalize your purchase order (collectively, the “Transaction Process”) for any good, item, material, substance, article, or product (hereinafter, collectively and individually referred to as the “Product” or “Products”) listed, depicted, described, advertised, or offered for sale on this website and its subdomains (the “Platform”), you, the user, visitor, customer, purchaser, or any other party acting on your behalf or utilizing your payment method (hereinafter “You,” “Your,” or the “Purchaser”), do hereby explicitly, irrevocably, and unconditionally affirm, warrant, and covenant that you have, prior to the completion of the Transaction Process, undertaken a thorough, exhaustive, and independently conducted investigation into the complete and current legal, regulatory, and administrative landscape governing the importation, possession, use, distribution, and disposal of the Product(s) you intend to acquire. This investigation must encompass, but is not limited to, all federal statutes, state or provincial codes, municipal ordinances, regulatory agency policies, customs import prohibitions, restricted materials lists, licensing prerequisites, permitting requirements, safety certification mandates, and any other applicable law, rule, or regulation (collectively, the “Governing Regulations”) as enacted, interpreted, enforced, and subject to amendment without notice by the competent authorities within your specific country, nation-state, federation, union, province, region, state, locality, and any other relevant jurisdiction constituting your primary delivery address and place of residence.
You further acknowledge, understand, and agree in perpetuity that we, the website operator, its parent company, subsidiaries, affiliates, successors, assigns, directors, officers, employees, independent contractors, agents, and representatives (collectively, “We,” “Us,” “Our,” or the “Company”), hereby expressly disclaim, deny, and renounce any and all forms of liability, responsibility, obligation, duty of care, or fault, whether in contract, tort (including negligence), strict liability, or under any other legal theory, for any and all consequences, damages, losses, or injuries arising from the interception, inspection, detention, refusal, seizure, condemnation, confiscation, or destruction of any shipped Product(s) by any governmental, quasi-governmental, or regulatory body, including but not limited to customs officials, border patrol agencies, law enforcement entities, postal inspectors, or public health authorities (collectively, “Authorities”) within your jurisdiction. This disclaimer of liability extends to any and all ancillary consequences you may incur as a direct or indirect result of such actions by the Authorities, including, without limitation, the initiation of criminal investigations, the filing of criminal charges, criminal prosecution, civil lawsuits, administrative penalties, the imposition of substantial monetary fines, the levying of customs duties and penalties, the forfeiture of assets, and any term of imprisonment or other punitive sentence you may face, particularly in instances where the Product(s) are allegedly misused, repurposed, employed in an unlawful manner, or applied in a fashion that violates, contravenes, or breaches any of the aforementioned Governing Regulations of your jurisdiction.
Furthermore, you explicitly agree and undertake that you shall be solely and entirely responsible for the payment of all costs, fees, charges, levies, and expenses associated with the shipment and delivery of the purchased Product(s) from our fulfillment facility to your designated delivery address (the “Shipping Costs”). These Shipping Costs include, but are not limited to, base freight charges, fuel surcharges, handling fees, packaging materials costs, insurance premiums (if selected), value-added taxes (VAT), goods and services taxes (GST), customs duties, import tariffs, brokerage fees, clearance charges, and any other tax or fee imposed by a shipping carrier or governmental authority in connection with the international transit of your order. All such Shipping Costs are non-refundable under any circumstances, except as expressly stipulated elsewhere in this agreement.
In the unfortunate and unforeseen event that a shipped package is formally declared lost, missing, or undeliverable by the third-party shipping carrier contracted for delivery (the “Carrier”) after a mandatory and often protracted investigation process has been completed to our satisfaction and to the satisfaction of the Carrier’s claims department, our sole and exclusive obligation, and your sole and exclusive remedy, shall be strictly limited to the dispatch of a replacement Product of equivalent type and quantity. Please be advised that this replacement shipment will be initiated only after we have successfully received, processed, and been credited a full and complete refund for the lost shipment from the Carrier, a bureaucratic and administrative process which is entirely outside of our control and may entail significant, indefinite, and unpredictable delays spanning several weeks or months, during which time you agree to hold us harmless and waive any claim for damages due to delay.
Regarding order cancellation requests: should you, the Purchaser, develop a change of intent and wish to cancel an order that has been successfully placed and for which payment has been processed and cleared, you must submit a formal written request for cancellation via the designated channel outlined in our Contact Us section. Provided that the order has not yet been physically transferred from our warehouse inventory to the possession and custody of the Carrier for final dispatch, you may be eligible to receive a partial monetary refund. This refund shall be calculated as precisely fifty percent (50%) of the total price of the Product(s) as listed on your order invoice, exclusive of all non-refundable Shipping Costs, any handling fees, and any payment processing fees which may have been incurred. Finally, you acknowledge that all estimated shipping and delivery timelines, including the prominently noted projected window of three (3) to four (4) weeks for international delivery, are provided to us by third-party Carriers and are presented as estimates only; they are not guaranteed delivery dates and are subject to extensive variability due to factors wholly beyond our sphere of influence, including, but not limited to, international customs clearance procedures, port congestion, transportation delays, weather disruptions, acts of God, labor disputes, geopolitical events, and any other force majeure events.
